In special cases, the arbitration will be administered by the arbitrators themselves. The parties may request the assistance of a state court or agency of justice for international arbitration as an appointing authority to provide a number of services, including those relating to the formation of the arbitral tribunal, if this is enabled by the arbitration clause, and a subsequent agreement between the parties.
During the previous years of administering arbitration proceedings, the Justice Agency for International Arbitration has gained exceptional experience in appointing arbitrators, forming arbitral tribunals, deciding arbitrators’ appeals and making decisions regarding certain arbitration costs.
To provide this service, the Justice Agency for International Arbitration applies a special set of rules: the Rules of the Justice Agency for International Arbitration as Appointing Authority. It is designed for use in proceedings under the Arbitration Rules of the United Nations Commission on International Trade Law or other arbitration procedures.
Process
When applying to act under the JAICA Rules as an appointing authority in arbitration proceedings of the United Nations Commission on International Trade Law or other arbitration proceedings, a party must submit an “Application” to the Secretariat of the International Court of Arbitration of the JAICA at any of its offices. . Each application must be accompanied by a non-refundable application fee as set forth in the Appendix to the Rules.
