Mental Intellectual Property

The development in the scope of legal studies has led to the emergence of a new category of rights with a dual nature, as it includes a financial aspect and a non-financial aspect. This new category is called “the category of intellectual rights.” These rights apply to intangible moral things that are the product of thought, and they allow their owner to monopolize his mental product, whatever its type, so that what he produced is attributed to him “such as artistic production” such as melody, photography, drawing, and sculpture, and “literary” such as writing, as well as patents, drawings, industrial models, and trademarks. These rights also allow their owner to exploit what he produced financially. From this, the two essential aspects of intellectual rights appear, namely: the moral aspect, which is represented by the person’s right to have what he produced attributed to him mentally as an extension of his personality, and the financial aspect, which is his right to exploit what he produced financially.
